The law applies to every facility
The ADA contains no grandfathering provisions. Places of public accommodation built before January 26, 1992 must remove barriers where readily achievable, and access should be re-evaluated on an ongoing basis.

What is a CASp inspection?
A CASp inspection is an on-site evaluation of a property’s accessibility, conducted by a California Certified Access Specialist. The inspection evaluates whether your building meets applicable state and federal accessibility standards, including the 2010 ADA Standards for Accessible Design and California Building Code Chapter 11B. The result is a written report identifying barriers and recommended remediation, plus a Certificate of CASp Inspection.
What is Qualified Defendant status?
Under California’s Construction-Related Accessibility Standards Compliance Act (CRASCA), a property owner with a current CASp inspection report qualifies as a Qualified Defendant. This grants three legal protections in a construction-related accessibility claim: reduced minimum statutory damages, a 90-day court stay to correct identified violations, and an early evaluation conference. These protections only apply if the inspection was completed before the lawsuit was filed.
Does the ADA apply to older buildings?
Yes. The ADA contains no grandfathering provision. Places of public accommodation built before January 26, 1992 are required to remove accessibility barriers where readily achievable. Buildings completed or altered after March 15, 2012 must meet the 2010 ADA Standards. Earlier compliance with the 1991 ADAAG may qualify for safe harbor under specific conditions.
How long does a CASp inspection take?
On-site time depends on property size and complexity, typically half a day to a full day for a single commercial location. The written CASp report is delivered after the visit. Statewide demand is high, with roughly 900 CASp inspectors covering 4.1 million California businesses, so scheduling lead times can run several weeks during peak demand.
What does a CASp inspection cost?
Cost varies by property type, size, scope, and location. Small commercial properties typically start around $2,000. Multi-tenant, hotel, and large commercial sites price higher. We provide a no-obligation estimate after a brief intake. Pricing is also affected by California’s inspector supply constraints, which we manage through our partner network.
Do I need a CASp inspection outside California?
The CASp designation is specific to California. Outside California, a built-environment ADA survey by an experienced accessibility professional serves a similar purpose, identifying barriers and documenting good-faith effort under federal Title III. Our team delivers both, depending on where your property is located.
